Why this question matters
AI tools are useful for drafting replies, sorting enquiries and cleaning up a customer list. The quick way is to paste a whole spreadsheet or chat into the tool. But a customer's name with a phone number is exactly the kind of information India's privacy law protects, so it is worth a minute's thought first.
What counts as personal data
The DPDP Act defines personal data as any data about an individual who is identifiable by or in relation to that data. A name and a phone number plainly identify someone. So does a chat that says who booked what and when. If the person can be identified, treat it as personal data.
You stay responsible
The Act calls a business that decides why and how data is used a Data Fiduciary, and a company that handles data for it a Data Processor. Section 8(1) says the fiduciary stays responsible for complying with the Act whatever agreement it has, including for processing done on its behalf by a processor. In plain words: if you paste customer data into a tool, the responsibility does not move to the tool.
What the Act asks of you
Section 8(5) says to protect personal data you hold, including data a processor handles for you, by taking reasonable security safeguards to prevent a breach. Section 8(2) says you may use a processor for work connected to offering goods or services only under a valid contract. Section 8(6) says that if a breach happens you must inform the Board and each affected person. PIB's explainer also lists data minimisation among the seven principles behind the Act: use only the data you need.
Why it is worth getting right
PIB states that the highest penalty, up to 250 crore, applies when a fiduciary fails to maintain reasonable security safeguards, and that failing to notify a breach can attract penalties of up to 200 crore. The Rules were notified on 14 November 2025 with an eighteen-month period for phased compliance, so check which duties apply on a given date with your adviser.
A safer habit (our advice)
- Remove names, phone numbers and addresses before you paste. Write "Customer A" instead.
- Paste only what the task needs, not the whole list.
- Read the tool's terms on how it stores and uses what you type, and prefer tools that give you a written contract or data terms.
- Keep customer lists in your own files, not in chat history you cannot delete.
- Tell staff the same rule, because one pasted spreadsheet is enough to break it.
This is general information, not legal advice. For your own case, ask your adviser.
Before your next AI task, swap real names and numbers for "Customer A" and "Customer B".
